Youtube, Dailymotion, ITUNES: WHEN CSA DISCUSSES INTERNET

The Superior Council of Audiovisual (CSA) application to control platforms YouTube and Dailymotion videos come , but also music as Apple iTunes , reports " The Express " , Tuesday, December 17 .

In a report to the Ministry of Culture and the Prime Minister , the weekly was able to consult the CSA states that " more and more publishing companies offer their audiovisual content on video sharing websites . This is the if Dailymotion , where all video rights holder can open an Official User account to share its catalog, and also YouTube . " Canal + has recently announced plans to offer programs on YouTube.

The CSA therefore calls on the government for legislative changes to extend its powers "in order to incorporate such distributors service under the French law."

Finance the creation

The Council also requested an evaluation from the sales within the publishing or distribution of professional content . And if it exceeds 10 million euros , YouTube and Dailymotion would then finance the French establishment and meet quotas of European works , says " The Express " .

In addition, platforms recognized as distributors should comply with obligations to provide the content editors " on fair, reasonable and non-discriminatory terms ." A measure that could also apply to shops and Apple Play Google , which would be obliged to provide VoD services as TF1 Video or CanalPlay AppStore applications.

The CSA has also asked the European Commission that the movie download services such as Apple's iTunes , Microsoft's Xbox Live , Sony Playstation Store or DisneyTek Free , should fall within the scope of the regulatory authority .

Inspired by Pierre Lescure

Most of these proposals are based on the report on Act II of the cultural exception , presented by Pierre Lescure last May. It pleaded for " a redefinition of certain statutes ," especially that of host. In Focus : iTunes and YouTube advising music and videos that appeal to the user based on its consumption. " This is not totally neutral ," thought Pierre Lescure . " We are not facing a pipe. Status must be redefined , so the responsibilities of actors today are too ambiguous. "

Pierre Lescure also advocated a review of the chronology of the media , that is to say, the timing of provision of works. His report proposed to advance the VoD broadcasting at 3 months ( against 4 months now ) and VoD broadcasting subscription ( SVOD ) to 18 months ( against 36 months now) . Ideas that were to fly CSA . The Council therefore suggests the Prime Minister and the Ministry of Culture to shorten the VoD 3 months and 18 months SVoD .

An Act Creating should be proposed by the government in early 2014. It could encompass both demand new powers of CSA and a review of the chronology of media. "This law will be presented to the Council of Ministers in February 2014," announced Minister of Culture , Aurélie Filippetti , the " Nouvel Observateur " .
